ARTICLE 1 - Scope

These General Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions” or “GTC”) apply, without restriction or reservation, to all sales entered into by the Seller with non-professional purchasers (“Customers” or the “Customer”) wishing to purchase the products offered for sale (“Products”) by the Seller on the website www.belladiscount.fr.

The Products offered for sale on the website are as follows:

Beauty, perfumes & cosmetics

Fashion, men’s and women’s items

Computer equipment and miscellaneous items

The main characteristics of the Products, including their specifications, illustrations and indications of dimensions or capacity, are presented on the website www.belladiscount.fr, which the Customer is required to review before placing an order.

The selection and purchase of a Product are the sole responsibility of the Customer.

Product offers are subject to availability, as specified when the order is placed.

These GTC are available at any time on the website www.belladiscount.fr and shall prevail over any other document.

The Customer declares that they have read and accepted these GTC by checking the box provided for this purpose before completing the online ordering process on the website www.belladiscount.fr.

Unless proven otherwise, the data recorded in the Seller’s computer system shall constitute evidence of all transactions entered into with the Customer.

The Products presented on the website www.belladiscount.fr are offered for sale in the following territories:

European Union and the rest of the world

For orders shipped to a country other than mainland France, the Customer shall be deemed the importer of the Product(s) concerned.

For all Products shipped outside the European Union and French overseas departments and territories, the price will automatically be calculated excluding taxes on the invoice.

Customs duties, other local taxes, import duties or state taxes may be payable. Such charges shall be borne exclusively by the Customer and remain the Customer’s sole responsibility.

ARTICLE 2 - Prices

The Products are supplied at the prices in force displayed on the website www.belladiscount.com at the time the order is registered by the Seller.

Prices are expressed in Euros, including all applicable taxes.

The prices take into account any discounts that may be granted by the Seller on the website www.belladiscount.fr.

These prices are fixed and non-revisable during their period of validity. However, outside that period, the Seller reserves the right to change prices at any time.

Prices do not include processing, shipping, transport and delivery charges, which are invoiced separately under the conditions indicated on the website and calculated before the order is placed.

The amount payable by the Customer corresponds to the total purchase price, including such charges.

An invoice is issued by the Seller and provided to the Customer upon delivery of the Products ordered.

ARTICLE 3 - Orders

It is the Customer’s responsibility to select the Products they wish to order on the website www.belladiscount.fr, in accordance with the following procedures:

Product offers remain valid for as long as they are visible on the website, subject to availability.

The sale shall only be considered valid after full payment of the price. The Customer is responsible for checking the accuracy of the order and must immediately report any error.

Any order placed on the website www.belladiscount.fr constitutes the formation of a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning payment of a previous order.

The Customer may track the progress of their order on the website.

Any cancellation of an order by the Customer shall only be possible before delivery of the Products, independently of the provisions relating to whether or not the statutory right of withdrawal applies.

ARTICLE 3 Bis - Customer Area - Account

In order to place an order, the Customer is invited to create an account (personal area).

To do so, the Customer must register by completing the form provided at the time of ordering and undertakes to provide truthful and accurate information concerning their identity and contact details, including their email address.

The Customer is responsible for keeping the information provided up to date. The Customer may amend such information by logging into their account.

To access their personal area and order history, the Customer must log in using their username and password, which will be provided following registration and which are strictly personal. The Customer undertakes not to disclose these details. Otherwise, the Customer shall remain solely responsible for any use made of them.

The Customer may also request the deletion of their account by visiting the dedicated page in their personal area or by sending an email to: info@belladiscount.fr. The deletion shall take effect within a reasonable period.

In the event of non-compliance with the General Terms and Conditions of Sale and/or terms of use, the website www.belladiscount.fr may suspend or close a Customer’s account after formal notice has been sent electronically and has remained without effect.

Any deletion of an account, regardless of the reason, shall result in the permanent deletion of all of the Customer’s personal information.

Any event resulting from force majeure causing the website or server to malfunction, as well as any interruption or modification due to maintenance, shall not incur the Seller’s liability.

Creation of an account constitutes acceptance of these General Terms and Conditions of Sale.

ARTICLE 4 - Payment Terms

The price shall be paid through secure payment methods, as follows:

Payment by bank card

The price is payable in full by the Customer on the date the order is placed.

Payment data is exchanged in encrypted form using the protocol defined by the approved payment service provider handling banking transactions carried out on the website www.belladiscount.fr.

Payments made by the Customer shall only be considered final once the Seller has actually received the amounts due.

The Seller shall not be required to deliver the Products ordered by the Customer if the Customer has not paid the full price under the conditions specified above.

ARTICLE 5 - Deliveries

Products ordered by the Customer shall be delivered in mainland France or within the following geographical areas:

European Union and the rest of the world.

Delivery times after dispatch vary depending on the destination and the address provided by the Customer when placing the order on the website.

Delivery Times

The delivery times displayed at checkout refer to transport time after dispatch.

The total delivery times, including preparation and dispatch, are indicated on each product page.

Switzerland and the United Kingdom:

0 to 5 kg = €28.00

Algeria:

0 to 5 kg = €25.00

Delivery Rates to Other Countries Outside the Eurozone Based on the Weight of Your Purchases:

0 to 5 kg = €92.00

For all countries outside the European Union, import duties and taxes shall be payable upon delivery of your parcel and shall remain entirely at your expense.

Delivery is deemed to have taken place when physical possession or control of the Product is transferred to the Customer.

Except in special circumstances or where one or more Products are unavailable, the Products ordered shall be delivered together in a single shipment.

The Seller undertakes to use its best efforts to deliver the Products ordered by the Customer within the times specified above.

If the Products ordered have not been delivered within 8 business days following the estimated delivery date, for any reason other than force majeure or an act or omission of the Customer, the sale may be terminated at the Customer’s written request under the conditions set out in Articles L216-2, L216-3 and L241-4 of the French Consumer Code.

Any amounts paid by the Customer shall then be refunded no later than fourteen days following the date on which the contract is terminated, without any compensation or deduction.

Deliveries are carried out by an independent carrier to the address provided by the Customer when placing the order, provided that the address is reasonably accessible to the carrier.

Where the Customer independently arranges transport using a carrier of their own choice, delivery shall be deemed completed when the Seller hands the Products ordered to the carrier, which accepts them without reservation.

The Customer therefore acknowledges that the carrier is responsible for completing the delivery and that the Customer shall have no warranty claim against the Seller in the event of non-delivery of the transported goods.

In the event of a special request from the Customer regarding packaging or transport conditions for the Products ordered, duly accepted in writing by the Seller, the related costs shall be subject to a specific additional charge based on a quotation previously accepted in writing by the Customer.

The Customer is required to inspect the condition of the Products delivered.

The Customer has a maximum period of 30 days from delivery, corresponding to the maximum return period, within which to submit any complaint by emailing info@belladiscount.fr, together with all supporting evidence, including photographs where applicable.

After this period, and if these procedures have not been followed, the Products shall be deemed compliant and free from any apparent defect, and no complaint may validly be accepted by the Seller.

The Seller shall refund or replace, as soon as possible and at its own expense, Products delivered for which a lack of conformity or apparent or hidden defect has been duly proven by the Customer, under the conditions provided for in Articles L217-4 et seq. of the French Consumer Code and these GTC.

The transfer of the risk of loss and deterioration relating to the Products shall only take place when the Customer physically takes possession of the Products.

The Products therefore travel at the Seller’s risk, except where the Customer has personally selected the carrier. In that case, the risks are transferred upon delivery of the goods to the carrier.

ARTICLE 6 - Transfer of Ownership

Ownership of the Products shall transfer from the Seller to the Customer only after the Customer has paid the price in full, regardless of the delivery date of the Products concerned.

ARTICLE 7 - Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code:

“For contracts providing for the regular delivery of goods over a defined period, the withdrawal period shall run from receipt of the first item.”

The right of withdrawal may be exercised online using the attached withdrawal form, which is also available on the website, or by means of any other unambiguous statement expressing the Customer’s intention to withdraw, including by postal mail sent to the Seller using the postal or email contact details stated in ARTICLE 1 of these GTC.

Returns must be made in their original and complete condition, including packaging, accessories and instructions, allowing the Products to be resold as new, and must be accompanied by the purchase invoice.

Damaged, soiled or incomplete Products will not be accepted for return.

Please note that returned Products must not have been worn, used or washed. Items from which the label has been removed or which are in poor condition cannot be returned.

BellaDiscount reserves the right to refuse any return that does not meet these conditions.

Restocking Fee: For any eligible item returned, a 15% restocking fee based on the purchase price shall be deducted from the amount refunded.

Return shipping costs shall remain the responsibility of the Customer.

Items excluded from the right of withdrawal: In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to perfumes and beauty products which may be unsealed after delivery and which cannot be returned for health protection or hygiene reasons.

These Products are considered final sale items and are not eligible for return or refund, whether opened or unopened.

An exchange, subject to availability, or a refund shall be made within 14 days of the Seller receiving the Products returned by the Customer in accordance with the conditions set out in this Article.

ARTICLE 8 - Seller’s Liability - Warranties

The Products supplied by the Seller benefit from:

the statutory guarantee of conformity for Products that are defective, damaged or do not correspond to the order;
the statutory guarantee against hidden defects arising from defects in materials, design or manufacture affecting the Products delivered and rendering them unsuitable for their intended use.

Provisions Relating to Statutory Warranties

Article L217-4 of the French Consumer Code

“The seller is required to deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery.

The seller shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation where installation was made the seller’s responsibility under the contract or was carried out under the seller’s responsibility.”

Article L217-5 of the French Consumer Code

“The goods conform to the contract:

1° If they are suitable for the use normally expected of similar goods and, where applicable:

if they correspond to the description given by the seller and possess the qualities presented to the buyer by the seller in the form of a sample or model;
if they possess the qualities that a buyer may legitimately expect having regard to public statements made by the seller, the producer or their representative, particularly in advertising or labelling;

2° Or if they have the characteristics defined by mutual agreement between the parties or are suitable for any special use sought by the buyer, made known to the seller and accepted by the seller.”

Article L217-12 of the French Consumer Code

“Any action resulting from a lack of conformity shall be subject to a limitation period of two years from delivery of the goods.”

Article 1641 of the French Civil Code

“The seller is bound by a warranty against hidden defects in the item sold which render it unfit for its intended use, or which so substantially reduce its use that the buyer would not have purchased it, or would only have paid a lower price for it, had the buyer known of those defects.”

Article 1648, Paragraph 1, of the French Civil Code

“Any action arising from redhibitory defects must be brought by the purchaser within two years from discovery of the defect.”

Article L217-16 of the French Consumer Code

“Where the buyer requests that the seller carry out repairs covered by a commercial warranty granted upon the purchase or repair of movable property, any period during which the goods are unavailable for at least seven days shall be added to the remaining warranty period.

This period shall run from the date of the buyer’s request for intervention or from the date the goods concerned are made available for repair, where this occurs after the request for intervention.”

To exercise their rights, the Customer must notify the Seller in writing, by email or postal mail, of any lack of conformity of the Products or the existence of hidden defects from the date on which they are discovered.

The Seller shall refund, replace or repair any Products or parts under warranty that are deemed non-compliant or defective.

Shipping costs shall be refunded on the basis of the amount invoiced, and return shipping costs shall be reimbursed upon presentation of supporting evidence.

Refunds, replacements or repairs of Products deemed non-compliant or defective shall be carried out as soon as possible and no later than 14 days following the Seller’s confirmation of the lack of conformity or hidden defect.

The refund may be made by bank transfer or bank cheque.

The Seller shall not be liable in the following circumstances:

failure to comply with the legislation of the country in which the Products are delivered, which it is the Customer’s responsibility to verify;
misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as normal wear and tear of the Product, accident or force majeure;
photographs and graphics presented on the website are non-contractual and shall not incur the Seller’s liability.

In all circumstances, the Seller’s warranty shall be limited to the replacement or refund of Products that are non-compliant or affected by a defect.

ARTICLE 9 - Personal Data

The Customer is informed that the collection of personal data is necessary for the Seller to sell the Products and to transmit such data to third parties for the purpose of delivering the Products.

Such personal data is collected solely for the performance of the sales contract.

9.1 Collection of Personal Data

The personal data collected on the website www.belladiscount.fr includes the following:

Account Creation

When creating a Customer/user account:

Surname, first name, postal address, telephone number and email address.

Payment

In connection with payment for the Products offered on the website www.belladiscount.fr, financial data relating to the Customer’s/user’s bank account or credit card is recorded.

9.2 Recipients of Personal Data

Personal data is used by the Seller and its contractual partners for the performance of the contract and to ensure the efficient provision of the sale and delivery of the Products.

The categories of contractual partners include:

Transport service providers
Payment service providers and financial institutions

9.3 Data Controller

The data controller is the Seller, within the meaning of the French Data Protection Act and, since 25 May 2018, Regulation (EU) 2016/679 on the protection of personal data.

9.4 Restriction of Processing

Unless the Customer expressly consents otherwise, their personal data shall not be used for advertising or marketing purposes.

9.5 Data Retention Period

The Seller shall retain the data collected for a period of 5 years, covering the limitation period applicable to contractual civil liability.

9.6 Security and Confidentiality

The Seller implements organisational, technical, software and physical digital-security measures to protect personal data against alteration, destruction and unauthorised access.

However, it should be noted that the Internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information over the Internet.

9.7 Exercise of Customers’ and Users’ Rights

Under the regulations applicable to personal data, Customers and users of the website www.belladiscount.fr have the following rights:

They may update or delete data concerning them by logging into their account.
They may delete their account by writing to the email address indicated in Article 9.3, “Data Controller”.
They may exercise their right of access to obtain information regarding their personal data by writing to the address indicated in Article 9.3, “Data Controller”.
If the personal data held by the Seller is inaccurate, they may request that the information be updated by writing to the address indicated in Article 9.3, “Data Controller”.
They may request the deletion of their personal data, in accordance with applicable data protection legislation, by writing to the address indicated in Article 9.3, “Data Controller”.
They may also request the portability of data held by the Seller to another service provider.
Finally, they may object to the processing of their data by the Seller.

Provided that such rights do not conflict with the purpose of the processing, they may be exercised by submitting a request by post or email to the Data Controller whose contact details are stated above.

The Data Controller must respond within a maximum period of one month.

If the Customer’s request is refused, reasons for the refusal must be provided.

The Customer is informed that, in the event of refusal, they may lodge a complaint with the CNIL (3 Place de Fontenoy, 75007 Paris, France) or bring proceedings before a competent judicial authority.

The Customer may be invited to check a box indicating that they agree to receive informational and promotional emails from the Seller.

The Customer may withdraw such consent at any time by contacting the Seller using the contact details above or by following the unsubscribe link.

ARTICLE 10 - Intellectual Property

The content of the website www.belladiscount.fr is the property of the Seller and its partners and is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an act of infringement.

ARTICLE 11 - Governing Law - Language

These GTC and all transactions arising from them are governed by and subject to French law.

These GTC are written in French.

If they are translated into one or more foreign languages, only the French version shall prevail in the event of a dispute.

ARTICLE 12 - Disputes

For any complaint, please contact Customer Service using the Seller’s postal or email address indicated in ARTICLE 1 of these GTC.

The Customer is informed that, in all circumstances, they may resort to conventional mediation through existing sector-specific mediation bodies or use any alternative dispute resolution procedure, such as conciliation, in the event of a dispute.
